CONCERNING
ISSUING AUTHORITY AND FORM OF HEALTH CERTIFICATE
OF FISH QUARANTINE AND HEALTH CERTIFICATE OF QUALITY AND SANITARY
OF FISH AND FISHERY PRODUCT

Considering :

• a. that in order to increase service of issuing health certificate of fish quarantine and health certificate of quality and sanitary of fish and fishery product, it necessary to establish authority of issuing and form of certificate thereof;
• b. that base on above fact, it is deemed necessary to establish by Decree of Minister;

• 4. Law No. 8/1999 concerning Consumer Protection;
• 5. Government Regulation No. 102/2000 concerning National Standardization of Indonesia;
• 6. Government Regulation No. 15/2002 concerning Fish Quarantine;
• 7. Decree of the President of the Republic of Indonesia No. 228/M/2001;
• 8. Decree of the President of the Republic of Indonesia No. 102/2001 concerning Status, Tasks, Functions, Authority, Organizational Structure and Working System of Departments as already amended by Decree of President of Republic of Indonesia No. 45/2002;
• 9. Decree of the President of the Republic of Indonesia No. 109/2001 concerning Organization Unit and Tasks of Echelon I in Departments, as already amended by Decree of the President of the Republic of Indonesia No. 47/2002;
• 10. Decree of Minister of Marine Affairs and Fisheries No. KEP.01/MEN/2002 concerning Intensive Quality Management System of Fishery Product;
• 11. Decree of Minister of Marine Affairs and Fisheries No. KEP.06/MEN/2002 concerning Requirement and Procedure of Inspection of Quality into Importation of Fish Product, which already amended by Decree of Minister of Marine Affairs and Fisheries No. KEP.43/MEN/2002;
• 12. Decree of Minister of Marine Affairs and Fisheries No. KEP.24/MEN/2002 concerning Systematization and Arrangement of Regulations within Ministry of Marine Affairs and Fisheries;
• 13. Decree of Minister of Marine Affairs and Fisheries No. KEP.05/MEN/2003 concerning Organization and Working System in Ministry of Marine Affairs and Fisheries;

HAS DECIDED :

To stipulate:

DECREE OF MINISTER OF MARINE AFFAIRS AND FISHERIES CONCERNING ISSUING AUTHORITY AND FORM OF HEALTH CERTIFICATE OF FISH QUARANTINE AND HEALTH CERTIFICATE OF QUALITY AND SANITARY OF FISH AND FISHERY PRODUCT

Article 1

Health certificate within Ministry of Marine Affairs and Fisheries comprises:

• a. Health Certificate of Fish Quarantine;
• b. Health Certificate of Quality and Sanitary of Fish and Fishery Product.

Article 2

(1) Health Certificate of Fish Quarantine as mentioned in Article 1 point a is issued by Fish quarantine officer at exit points whenever it is required by destination country. It declares that carrier media is free from pests and diseases of fish and/or quarantine pests and diseases of fish, which is prohibited by destination country.

(2) Fish Quality Controller issues Health Certificate of Quality and Sanitary of Fish and Fishery Product as mentioned in Article 1 point b, which is appointed by Minister of Marine Affairs and Fisheries casu quo Director General of Capture Fisheries. Certificate declares that condition of fishery product is sanitary for exporting and safe for human consumption.

Article 3

(1) Form of Health Certificate of Fish Quarantine as mentioned in Article 1 point a is as in Annex 1 of this Decree.

(2) Forms of Health Certificate of Quality and Sanitary of Fish and Fishery Product as mentioned in Article b are:

• a. If product is exported to European Union countries as:
• 1) general fish product, the form is as in Annex 2 of this Decree;
• 2) frogsElegs, the form is as in Annex 3 of this Decree;
• 3) snails, the form is as in Annex 4 of this Decree.
• b. If product is exported to Non-European Union countries, form as in Annex 5 of this Decree shall be used.

(3) Nomenclature used in Health Certificate of Quality and Sanitary of Fish and Fishery Product is adapted to regulations or provisions, which is prevailed in destination country.

Article 4

(1) Parasite or pest of fish which is to be targets of inspection by quarantine officer in order to issue Health Certificate of Fish Quarantine as mentioned in Article 1 point a and Article 2 section (1) list in Annex 6 of this Decree.

(2) Targets of inspection by Fish Quality Controller in order to issue Health Certificate of Quality and Sanitary of Fish and Fishery Product as mentioned in Article 1 point b and Article 2 section (2) list in Annex 7 of this Decree.

Article 5

(1) Copy of Health Certificate of Fish Quarantine as mentioned in Article 2 section (1) is sent to Director General of Capture Fisheries casu quo Director of Processing and Quality Control.

(2) Copy of Health Certificate of Quality and Sanitary of Fish and Fishery Product as mentioned in Article 2 section (2) is sent to Secretariat General casu quo Director of Centre for Fish Quarantine.

Article 6

(1) Implementing Units who serve issuing of Health Certificate, either developed by Centre for Fish Quarantine or developed by Directorate of Processing and Quality Control, shall give information about importance and urgency of it to all of their stakeholders.

(2) Information as mentioned in section (1) is completed by list of fish parasites/pests, parameter, and cost of service according to prevailed regulations.

Article 7

In order to increase effectiveness and efficiency of administration of issuing Health Certificate, concerned members within Ministry of Marine Affairs and fisheries shall form a Joint Committee.

Article 8

This Decree shall come into effect on the date of issuance.
